Fairfax Kidnap Suspect Appears in Court

The omnibus hearing for the man arrested for allegedly abducting and assaulting a teenage girl in Fairfax was held this morning at the Renville County Courthouse.News 12s Sara Miles was at the hearing and has the latest.Dion... Twenty five year old Matthew Thomas Fahey pleaded not guilty to charges today that involve him sexually assaulting and kidnapping a 14 year old Fairfax girl.Now with the plea out of the way, there is still a lot of work to be done before the trial begins.((nats of cars))It was here in Fairfax where Matthew Fahey allegedly picked up a girl on her paper route back in May.According to the complaint the girl says Fahey forced her into his vehicle and sexually assaulted her...It wasn't until she says she had to jump out of her kidnapper's car into a ditch... that she was free.And today it was factors from that complaint that were brought up by Fahey's attorneys.Asst. Renville County Attorney Glen Jacobsen says, "What they did raise was in the rules that allows them to bring an issue regarding the aggravating factors."Those factors can be used by the prosecution to further state their claim or increase a sentence...And because of the issue it's now up to both sides to provide more insight and formulate questions that will be sent out to potential jurors.Jacobsen says, "additional personal information from them regarding their thoughts beliefs and feelings in dealing with a case that is often very personally touching and traumatic."Fahey is currently being held on criminal sexual predatory conduct, kidnapping, and two counts of first-degree criminal sexual conduct.... involving great bodily fear and force.It's with cases like this that pull at the heartstrings of everyone involved...Jacobsen says, "just because we don't want to think about someone being in that type of situation... on the other hand someone has to speak... but you don't want to be doing the hugging crying thing if you cant in anyway help it."Both the defense and prosecution now have to work out their differences with the aggravating factors as well as await the results of DNA testing...After that the trial is scheduled to begin in January.In Olivia, SM, News 12
